This contract is between Fitzdoodles Kennel LLC administered by Abigail Atkinson (hereafter “Seller”) and _______________________________(hereafter “Buyer”).

General Terms:
The following conditions apply to the aforementioned dog:
The buyer has three days after receiving the dog to have the dog examined by a licensed veterinarian. If a life-threatening problem is found, return of dog must be arranged in the three days. A signed form from a licensed veterinarian describing the life-threatening problem found must be sent within the three days and dog must be physically returned within seven days. If dog is not physically returned within seven days, buyer assumes all care and expenses of dog and return becomes void. Once dog is received, a refund of dog’s purchase price will be given to buyer. If the dog is not examined by a licensed veterinarian in the first three days, the health warranty becomes void.
The genetic disorder warranty covers the dog for the first year of its life. If your dog is found, by a licensed veterinarian, to have one of the following genetic disorders in the first year of its life, the seller will refund dog purchase price. Qualifying genetic disorders include: heart, hip, eye, elbow, and vWD. Refund of purchase price for genetic defects will be made only when a second opinion from a certified veterinarian and proof of surgery expenses are provided. In the rare case of death, the puppy will be replaced free of charge if within the first year of its life and a necropsy report completed by a certified veterinarian must show the cause of death was caused by a genetic issue. Shipping fees are at the buyer’s expense.
Heart murmurs are often found in small breed dogs and most innocent grade two puppy murmurs go away in a few weeks to months. We will work with a buyer if a heart murmur is found and if PRE surgery documentation from two unaffiliated veterinarians is provided.
Luxating Patellas are more common in small breeds. Patellas can be loose at this young age and can tighten up on their own with more exercise and strength as they grow. I have found that vet’s opinions on patellas and gradings can vary widely! From one to two degrees of grading. If a puppy checks good, in regards to their patellas, at their first two vet checks (here and your vet) and have a luxating patella later on, this means they have injured their knee and is not covered. If my vet deemed the patellas good and your vet says they are loose, then a third unaffiliated vet opinion will be required. If grade 1 patellas are found, $100 off each and if grade 2 patellas are found $200 off each.
Any discount given on a condition, will void future claims for that condition. The maximum Fitzdoodles LLC will cover on any claims with this guarantee is only up to the price of the puppy.
Warranties apply to original owner only. Should ownership of dog be transferred at any point, this contract, including the warranties, becomes void.
Seller makes no guarantee that dog will not shed or cause allergic reaction.
Seller can’t guarantee a certain coat, color, height, weight, or temperament at adulthood. Projections of a dog’s coat, color, height, weight, and temperament are estimated by the seller but not guaranteed.
There will be no circumstances in which the Seller will be liable to the Buyer or to any third party for a dog that has experienced any abuse, accident, negligence, or any damages resulting from or in any manner related to the dog.
Viral illnesses are not included in this warranty. Improper bites, infections, or hernias are also not included in this warranty. The Seller guarantees the puppy against fatal viruses for 72 hours. This includes Distemper, Parvo, and Corona. Not covered are Coccidiosis and Giardia, because they are commonly found in puppies and may or may not cause symptoms.
The excitement and surroundings of a new home can cause enough agitation for a dog to show signs of physical and mental stress. This is a reasonable expectation and the buyer’s financial responsibility. The seller has done everything possible to avoid and clear parasites. This contract does not include any illness due to the dog ingesting any foreign food, objects, or chemicals. Physical injury or issues whose cause is unknown or may be caused by the environment are also not covered in this contract. Once this contract is signed by both buyer and seller, ALL veterinary care and its associated costs are the sole and exclusive responsibility of the buyer.
Dog Maintenance
Buyer will be provided a list of all vaccinations received while in the Seller’s care. Vaccines will be current when dog is delivered. Buyer understands and commits to keeping up with vaccines throughout the dog’s life. Buyer’s understand proper dog maintenance is required and that buyer is solely responsible for any cost related to these expenses.
Legalities
In the event a dispute shall arise between the parties to this contract, every effort should be made for the dispute to be handled solely between buyer and seller. If a settlement can’t be found, the parties (buyer and seller) agree to participate in at least four hours of mediation in accordance with the mediation procedures of United States Arbitration & Mediation. The parties agree to share equally in the costs of the mediation.
Mediation involves each side of a dispute sitting down with an impartial person, the mediator, to attempt to reach a voluntary settlement. Mediation involves no formal court procedures or rules of evidence, and the mediator does not have the power to render a binding decision or force an agreement on the parties. Mediation will be required before any court procedures will be considered.
Full and Final Agreement
By signing either personally or by electronic signature, buyer agrees to all terms outlined within this contract. Both Buyer and Seller agree this represents the entirety of the agreement between both parties and no other representations have been made or implied regarding the dog. This contractual agreement is made, executed and will remain in the jurisdiction of the State of Utah.
